HOUSSIERE, DURANT & HOUSSIERE WINS $526,925.00 VERDICT IN

A MEDICAL MALPRACTICE CASE AGAINST LOCAL SURGEON

  A Weatherford, Texas jury awarded $526,925.00 including pre-judgment interest, plus court costs, verdict bought by longtime residents Beth and Darryl Pratt against a local orthopedic surgeon, Dr. Jeffrey Scott Smith, and Lone Star Pain Medicine, L.L.C. Defendants made no offer to settle this case; instead, defendants’ counsel stated that they would ask the court to order the Pratts to pay approximately $9,000.00 in court costs. The Plaintiffs brought a Texas Board Certified Orthopedic surgeon and a Texas Board Certified Neuro Radiology Professor as experts against Dr. Smith. Defendant Smith brought a Board Certified Orthopedic Surgeon as his expert. The jury found Dr. Smith negligently screwed a pedicle screw into the patient Beth Pratt’s spine injuring her spinal nerve. Beth Pratt was rushed to the hospital in excruciating pain. A second repair operation was performed, to reposition the screw, unfortunately, Dr. Smith made a second error when the repositioned screw protruded into the disc space above. Additional surgery was required by a neurosurgeon to remove the screw and repair the adjoining disc spaces. Beth Pratt is left with weakness and pain. The two week trial was presented by Charles R. Houssiere, III and Randal A. Kauffman of Houston, Texas. The Houston firm currently has another case pending against Dr. Smith and Lone Star Pain Medicine, L.L.C. on behalf of another client.
